Director: Graham Billingsley) Public Hearing re: Docket #DC-04-05 Readoption and amendment of Sections 8-200 through 8-601 of Article 8 of the Boulder County Land Use Code ("Regulations for Activities and Areas of State Interest," also commonly known as the County’s "1041 Regulations") designating and adopting guidelines (regulations) for the following areas and activities of state interest, as provided in Article 65.1 of Title 24 of the Colorado Revised Statutes (C.R.S.), as amended ("the Act"):

(1) Site selection and construction of major new domestic water and sewage treatment systems, and major extension of existing domestic water and sewage treatment systems;

(2) Efficient utilization of municipal and industrial water projects;

(3) Site selection and construction of major facilities of a public utility;

Site selection of arterial highways and interchanges and collector highways;

(5) Site selection and development of new communities;

Areas around key facilities in which development may have a

material effect upon the key facility or the surrounding community

(key facilities being interchanges involving arterial highways);

(7) Areas containing, or having a significant impact upon, historical, natural, or archaeological resources of statewide importance; and

(8) Natural hazard areas, which are flood hazard areas (including floodplains and other areas containing or directly affected by a flood) and geologic hazard areas.

This readoption of the County’s existing 1041 Regulations has been prompted by the Boulder District Court’s decision in Case No. 01CV1896, The Regents of the University of Colorado vs. County of Boulder, dated October 5, 2004, declaring certain parts of the existing 1041 Regulations invalid due to the failure of the Colorado Land Use Commission to convene to review the Regulations as provided in the Act. In addition to the readoption, certain amendments to the existing 1041 Regulations are proposed.
